everygrocer is an online market where independent neighborhood shop owners sell groceries — produce, dry goods and prepared food — to customers nearby. By using everygrocer.com you agree to these terms. Please read them; the sections on food safety and allergens matter.

1. What everygrocer is

everygrocer operates a marketplace. Each shop on the site is run by an independent shop owner who sources, describes, prices, packs and hands over their own goods. everygrocer does not grow, buy, store or handle any product sold on the site.

For card payments, everygrocer is the merchant of record: the charge on your statement will read "everygrocer", and everygrocer collects the payment on the shop owner's behalf and passes it on to them after deducting a platform fee. This does not make everygrocer the seller of the goods — the shop owner remains the seller.

2. Accounts

You sign in with a Google account or a one-time link sent to your email. There are no passwords. Keep access to that email account secure — anyone who can read your email can sign in as you.

You must be at least 18 to open a shop. Customers must be able to enter into a binding purchase where they live.

3. Shop owners are independent sellers

Shop owners are not employees, agents or partners of everygrocer. They are solely responsible for the goods they sell, including sourcing, quality, freshness, weights, labeling, pricing, storage, handling, packaging and hand-over.

Shop owners must hold any permits or licenses their locality requires to sell food (for example a cottage food registration or a retail food permit), collect and remit any sales tax they owe, and comply with all applicable laws. everygrocer does not verify these and is not responsible for a shop owner's failure to comply.

Shop owners receive payouts through Stripe Connect and agree to Stripe's Connected Account Agreement. Payouts are released by everygrocer after delivery is confirmed, on a weekly schedule, and may be held back to cover refunds, disputes or suspected fraud.

4. Food safety and allergens — read this

All product information on everygrocer — descriptions, ingredients, origin, weights, photos, storage advice and allergen labels — is written by the shop owner, not by everygrocer. everygrocer does not inspect, test or verify any product or any claim about it.

Allergen labels are provided by shop owners as a courtesy and may be incomplete or wrong. Prepared food may be made in home kitchens that also handle peanuts, tree nuts, milk, eggs, fish, shellfish, soy, wheat and sesame. If you have a food allergy or intolerance, contact the shop owner before ordering and make your own judgment. Do not rely on the label alone.

TO THE FULLEST EXTENT PERMITTED BY LAW, EVERYGROCER DISCLAIMS ALL LIABILITY FOR ILLNESS, ALLERGIC REACTION, INJURY OR LOSS ARISING FROM ANY PRODUCT SOLD BY A SHOP OWNER, INCLUDING FROM INACCURATE OR MISSING ALLERGEN OR INGREDIENT INFORMATION. Your claims regarding a product are against the shop owner who sold it.

5. Prices, weighing and estimates

Many fresh items are sold by weight. Some are weighed before listing and show a fixed price. Others are weighed after you order: for those the listing shows an estimated price range, and the final charge is the shop owner's actual weighed amount at the listed per-weight price. By ordering such an item you authorize the shop owner to charge your saved card for the weighed amount once it is known.

Prices are set by shop owners. Platform fees, where shown, are included in the total you see before you pay. Sales tax, if applicable, is the shop owner's responsibility.

6. Payment

Card payments are processed by Stripe. everygrocer never sees your full card number. When an item is weighed after ordering, your card is saved with Stripe and charged once the final amount is known.

Some shop owners also accept Zelle or Venmo. Those payments go directly from you to the shop owner's own account; everygrocer does not receive, hold or transfer that money and cannot reverse it. Zelle has no buyer protection. Only send money to the account shown on your order page, include the order code in the memo, and understand that the shop owner will not release the order until they see the funds. Any refund of a Zelle or Venmo payment must come from the shop owner directly.

7. Cancellations, refunds and disputes

Refunds are governed by our Refund Policy. In short: use "Contact the shop" on your order page to raise a problem; the shop owner or everygrocer may issue a refund for card orders; Zelle/Venmo refunds are the shop owner's to make.

If you open a card dispute (chargeback) with your bank for an order you received, everygrocer may suspend your account.

8. Acceptable use

Do not use the site to sell anything you are not legally allowed to sell, misrepresent goods, upload content you do not have rights to, scrape the site, interfere with its operation, or harass other users. everygrocer may remove listings, cancel orders and suspend or close accounts at its discretion.

9. Limitation of liability

everygrocer provides the marketplace "as is". To the fullest extent permitted by law, everygrocer is not liable for any indirect, incidental, special or consequential damages, and its total liability to you for any claim relating to the site is limited to the platform fees everygrocer received on the order in question.

Nothing in these terms limits rights you have under law that cannot be waived.
